Break and Entry Incidents in Fort Erie
October 2013 saw a series of break and enter incidents in the Fort Erie area. Niagara Regional Police reported successful arrests in connection with the incidents. Under Section 348 of the Criminal Code of Canada, break and enter into a dwelling-house is a serious indictable offence carrying up to life imprisonment; break and enter into a place other than a dwelling carries up to ten years. A successful defence often hinges on whether the accused had permission to enter, whether they were lawfully present, and how the word “place” is defined under the Criminal Code. which includes dwelling-houses, other structures, vehicles, trailers, and even enclosures for fur-bearing animals.
