Midland Police Officer Assaulted During Traffic Stop
A Midland police officer conducting a routine traffic stop. after a vehicle’s spoiler fell off. was assaulted by the driver when the officer attempted to detain him. The driver, later identified as Terrance Belcher, pulled over into a parking lot, then attempted to flee. When the officer grabbed him, Belcher punched the officer repeatedly in the face and body. The officer ultimately gained control by using pepper spray and striking Belcher in the rib cage. It was then discovered that Belcher had an outstanding arrest warrant. He was charged with assault and resisting arrest, among other offences. Assaulting a police officer is a serious criminal offence in Ontario. Barrie Resident Sentenced for HIV Sex Assault
A Barrie resident was sentenced to 39 months in prison on September 20, 2013 after being convicted of aggravated sexual assault. The conviction arose from unprotected sexual contact without disclosing an HIV-positive status to a partner. Justice Gregory Mulligan accepted a joint submission from defence and Crown, crediting 15 months of pre-trial custody. The individual was also placed on the sex offender registry and sentenced to three years of probation following release. The case turned on an important legal point: the Supreme Court of Canada has held that a person with HIV must disclose their status to a sexual partner unless a condom is used, regardless of whether the viral load is medically undetectable.
